New regulations for tourist rentals in Comunidad Valenciana region.

From August 2, 2024, new regulations will apply to tourist rentals in the Comunidad Valenciana, which includes the provinces of Alicante and Valencia.

Maximum number of licenses per building/zone/area

Local councils in Spain have the power to limit the maximum number of tourist rental licenses per building, area or zone.
This can regulate the availability of tourist properties in certain regions, which can affect your ability to rent out property.
It is therefore essential to be well informed about local regulations before investing in a tourist property.

Maximum rental period for tourist purposes

In Spain there are specific rules for renting property for tourist purposes.
An important aspect of this is the maximum rental period for tourist rentals to the same tenant.
This period cannot exceed 10 days.
Renting for a period that exceeds this limit is considered short-term rentals and does not fall under the tourist rental rules.
As a result, registration as a tourist property is not required for such rentals.

Validity of rental licenses

Current tourist rental licenses are valid for a period of 5 years.
To renew the registration, the owner must submit a new responsible declaration of renewal within the month prior to the expiration of this period.
A recent municipal report confirming the suitability of the property for tourist use based on urban development compatibility must also be submitted.

For homes that already have permits, the 5-year validity period will start from the date the new decree comes into force.
This means that permits for existing customers must be renewed to remain valid beyond July 2029.

Room rental for tourist purposes

In Spain today, it is forbidden to rent out rooms separately for tourist purposes.
This rule applies to most regions, focusing on regulating rental practices to ensure the quality of tourist accommodations and prevent nuisances.

Additional supplies application rental license

In addition to the documents already required to apply for a rental license, the following documents will also become mandatory:

  • Certificado de Eficiencia Energética, or Certificate of Energy Conservation or Energy Performance Certificate.
  • The certificate from the community that the property may be used for tourist rental.

Property accessibility and equipment requirements

For this, reference is made to technical building code and other applicable regulations.
Consider fire technical facilities, dimensions of spaces, cooling and heating of the space and accessibility for people with disabilities.
