Welcome to Your Ibiza!
Your Ibiza B.V. offers an online platform that you can use to prepare a trip to Ibiza.
You can find information and book relevant tours, tickets and third-party services related to Ibiza.
These terms and conditions of use (the ‘Terms and Conditions’) govern the relationship between Your Ibiza B.V. and its users (‘Users’) when using the ‘Your Ibiza’ mobile application (the ‘App’), website www.your-destinations.com (the ‘Website’), and (the purchase of) services or Products as offered by Your Ibiza B.V. and through third-party providers.
Your Ibiza B.V. offers the use of the Website and the App and of its services or products subject to the user’s agreement to these Terms and Conditions.

1. DEFINITIONS
1.1 Your Ibiza B.V.: Your Ibiza B.V., a company incorporated under Dutch law.
The company is registered in the Trade Register of the Dutch Chamber of Commerce under number 70892962.
The company is located at Van Vollenhovenstraat 5, 5652 SN Eindhoven, the Netherlands.
Your Ibiza B.V. is hereinafter also referred to as “we”, “us”, “our” and “Your Ibiza”.
1.2 User: a person who uses the Website or the App or purchases the services or products offered by us.
Hereinafter also referred to as ‘you’.
1.3 Platform: the Website https://www.your-destinations.com and the App ‘Your Ibiza’ with information about Ibiza.
1.4 Products: a range of accommodations, (flight) tickets, car rentals and services made available by third-party providers and related to Ibiza.

2. USING OUR WEBSITE AND APP
2.1 To use our App, you must download and install our App.
You cannot create a personal account.
2.2 If you want to use our website, please go to https://www.your-destinations.com. You cannot create a personal account.
2.3 By using our Website and the App, you certify that you are at least 16 years old.
If you are under 16, you will need permission from a parent (or legal guardian) to use our Website or App.
2.4 The terms of agreement with Users’ mobile network providers (“Mobile Provider”) shall continue to apply when using the Website or the App.
This may result in the Mobile Provider charging the User through the use of the Website or the App for the duration of the network connection for accessing these network services, or similar charges by third parties.
The User is responsible for the incurrence of such charges.
2.5 You may use the Website or the App only if you agree that you will not provide any data or content to us or the Platform (or through the Platform) that is inaccurate, untrue, or incomplete, or in violation of any law or regulation.
In addition, you agree that you will:
1.
a) will not enter non-public / secure areas of the Platform;
2.
b) not send viruses, junk mail, spam, unsolicited offers or advertisements of any kind and for any purpose; and
3.
c) not examine, scan or test the Platform or any related system or network or breach its security or authentication.

3. PRODUCTS
3.1 Your Ibiza B.V. offers different types of Products: products provided by third parties such as airline tickets, car rentals, accommodations and club tickets sold directly through our Website and App.
3.2 Your Ibiza B.V. is not a travel agent and does not offer its own tours, excursions, transport services, accommodation or other travel experiences.
Your Ibiza B.V. displays information about Products and experiences offered exclusively by third-party providers and offers customers the opportunity to book with these providers.
3.3 If the User provides Your Ibiza B.V. with certain information – such as a date of departure or your dates of stay – Your Ibiza B.V. may assume that this information is correct and will display Products based on this information.
3.4 The purchase of a Product is completed when the User pays the price indicated for that Product and this payment is received by Your Ibiza B.V. in good order.
3.5 All other Your Ibiza B.V. Products (Products not listed as such on the Website or in the App) are without obligation, unless otherwise agreed in writing.
3.6 Products that hyperlink the User to a third party’s website are made by third parties.
Obvious errors and mistakes regarding Products are not binding on Your Ibiza B.V. or third parties.

4. CHANGING AND CANCELLING BOOKINGS
4.1 All changes and cancellations of bookings of Products with a specific date must be communicated by email to redactie@your-destinations.com.
4.2 Sometimes our suppliers change the prices, dates, contents or other features of the Product.
In doing so, Your Ibiza B.V. has the right to cancel, change or replace any service or tour and any ticket or Product booked by the User at any time and for any reason.
If you are dissatisfied with any alternative offered then the original purchase price will be fully refunded.
If your-destinations.com learns that a significant change to a booking and/or event or Product has occurred, we will make reasonable efforts to notify you so that the booking can be adjusted.

5. INFORMATION ON THE WEBSITE AND IN THE APP, DISCLAIMER OF WARRANTIES
5.1 The information about Ibiza on the Website and in the App has been compiled with the utmost care.
This information is offered for information purposes only and does not constitute advice.
To the extent permitted by law, Your Ibiza B.V. also disclaims any tacit guarantee regarding the information offered on the Website and in the App.
The information on the Website and in the App is offered in its condition and based on availability, without any form of guarantee.
5.2 The User understands that information about products and services offered by third parties on the Website and in the App is from third parties and has not been compiled or suggested by Your Ibiza B.V..
This information is therefore offered without any guarantee or warranty of accuracy.
This also means that if the information about third-party products and services on the Website and in the App differs from the information on the website of the third parties offering the products and services, the information on the third-party website should be considered correct.
5.3 Your Ibiza B.V. is not liable for:
1.
(a) the information about Ibiza offered on the Website and in the App and damages incurred by the User as a result; or
2.
(b) decisions made or purchases made by the User based on the information about Ibiza offered on the Website and in the App.
The User is solely responsible for his interactions with third parties with whom he has come into contact through the Platform or with other Users of the Website or the App.

6. OUR NEWSLETTER
6.1 To receive our newsletter you must provide us with your name, email address and date of birth using the appropriate form on our Website or in the App.
6.2 By providing us with your email address through the appropriate form, you agree to us sending you our newsletter on a regular basis.
6.3 Users have the right to unsubscribe from the newsletter at any time.
Please let us know that you wish to unsubscribe from the newsletter by sending an e-mail to redactie@your-destinations.com, or click on the appropriate button found in each newsletter.
We will send you a confirmation as soon as possible, but no later than 5 days.

7. PRIVACY
7.1 We respect your privacy and comply with the General Data Protection Regulation (GDPR) in force in the EU.
When you use our Platform, we collect certain personal data about you.
Our Privacy Policy tells you what personal data we collect and for what purposes.

8. AVAILABILITY OF THE WEBSITE AND THE APP, DISCLOSURE OF GUARANTEES
8.1 The Website and the Apps are available on PCs, tablets and smartphones.
Your Ibiza B.V. will make reasonable efforts to ensure that the Website and the App are available at all times.
However, the User acknowledges that the Website and the App are made available via the Internet and mobile networks and that the quality and availability of the Website and the App may therefore depend on factors reasonably beyond Your Ibiza B.V.’s control.
8.2 Your Ibiza B.V. accepts no responsibility for the unavailability of the Website and the App, or for problems or inability to download or access content or other failures in communication systems that may result in the unavailability of the Website or the App.
8.3 Your Ibiza B.V. is not responsible for support or maintenance relating to the Website or the App.
Your Ibiza B.V. may – at its discretion – update, change or modify the Website or the App and its functionality from time to time to improve the User experience.
As a result, the Website or the App may not be available for some time.

9. LIABILITY
9.1 Third Party Providers found through Products or services on this Website or in the App are independent contractors and not partners or employees of Your Ibiza B.V. Your Ibiza B.V. shall not be liable for any acts, errors, commissions, representations, warranties, breach, omissions or misconduct of these Providers or for any personal injury, death, property damage or other damages or costs arising out of or otherwise arising out of your booking of any Product or service or your use of any Product or service.
9.2 Your Ibiza B.V. is not liable for and does not refund money in case of delay, strike, force majeure or other causes beyond our control and we are not responsible for additional expenses, commissions, delays, re-routing or intervention by any government or authority.
9.3 Your Ibiza B.V. is not liable to you for any damage (direct or indirect) you suffer as a result of using the Website or the App or its content.
For example, Your Ibiza B.V. is not liable for:
(a) the performance of agreements between you and third parties to whose products and services the Website or App refers, or vice versa;
(b) the unavailability (for a certain price) of products or services of third parties to whose products and services the Website or App refers or vice versa, preventing the User from purchasing a product or service;
(c) correct operation of the (hyper)links contained on the Website or in the App;
(d) the situation where a User’s device is stolen and a third party subsequently uses the Website or App through the User’s mobile device;
(e) any damage or alteration to User’s equipment, including, but not limited to, computer equipment or a portable device, resulting from the installation and use of the Website or App.

10. OTHER PROVISIONS
10.1 Your Ibiza B.V. reserves the right to amend these Terms and Conditions.
When we amend these Terms, we will notify Users by newsletter (if the User has provided us with their email address for this purpose) and will post a notice on our Website with the updated Terms.
By continuing to use the App or the Website, you agree to the most recent version of these Terms.
10.2 Our failure to enforce any part of these Terms should not be construed as consent or waiver of our right to enforce them at a later time or with respect to any other User.
